ROCHESTER, N.Y. (ChurchMilitant.com) – A father arrested and charged with criminal trespassing for refusing to wear a mask at his son’s baseball game was cleared of all charges and is preparing to sue his school district.

Chad Hummel will sue the East Irondequoit Central School District in Rochester, New York, after being banned from school property and rendered unable to attend his son’s graduation last May.

In a statement, Hummel explained that, originally, he would have accepted “a public apology, some resignations and a change to the school code of conduct, in lieu of monetary damages.” But he noted that “now that the district sought to criminalize him, damage his professional career and hurt his family, he’s reconsidering.”

Hummel, an attorney, could have faced 90 days in jail and professional licensing consequences if convicted. But after a quick four-hour trial, Judge Joseph J. Valentino fully acquitted him.

According to a press release from Mr. Hummel, two witnesses on the prosecution’s side gave “untrue testimony under oath” during the trial.

A sign on the entrance said masks were optional.

He “cannot elaborate on their identity or the nature of the untrue testimony. … Civil litigation is the appropriate forum for that truth to come out,” the statement added. Hummel’s statement reaffirmed that he was standing maskless and “alone in a field, hundreds of feet from anyone” before police handcuffed and jailed him.

Hummel also noted that a security guard hired by local police “ordered Hummel to leave his son’s baseball game — despite the executive order at the time that did not require outdoor masking. There was even a sign on the stadium entrance that said masks were optional when six feet apart.”

In February, Dave Calus, a different parent, was physically

removed

from a Webster, New York, school board meeting after refusing to wear a mask. Hummel is representing Calus as Calus undergoes an investigation.

Speaking to Fox News, Hummel lampooned Webster school district officials, calling them “such hypocrites.” Following Calus’ removal, the school board received scrutiny when a

 surfaced of five board members going maskless.

Jen Lunsford, the board official that tweeted out the photo defended the maskless picture, saying, “We took off our masks for 30 seconds while the photo was taken. You can see other masked individuals in the background.”

Not satisfied by Lunsford’s weak defense, Hummel opined, “Even if what she says is true — that it’s 30 seconds — why does she get to make that judgment call? Because she thinks she knows better than everyone else, right?”

He continued by raising the fact that children are given “no option” not to mask.
